授業の概要

This course explores the foundations, functions, and global variations of constitutional law. Drawing on John Locke’s vision of constitutionalism as a safeguard for life, liberty, and property, the first semester introduces students to the philosophical and historical roots of constitutional governance, examining how constitutions emerge, evolve, and constrain power. The second semester shifts to comparative analysis, using case studies from around the world to explore how different systems address rights, structure government, and respond to crises. Through readings, debates, and projects, students will gain an understanding of how constitutional principles are interpreted and contested across diverse legal and political landscapes.
This Comparative Constitutional Law course is offered in both semesters, and students may register for one or both semesters.

科目目的

This course is designed for students interested in the theory and practice of constitutional governance across different countries. Students will:
-Explore the philosophical foundations of constitutionalism, especially Locke’s theory of government by consent and the protection of natural rights.
-Understand the structural components of constitutions and their role in limiting power.
-Analyze how different countries design and interpret their constitutions.
-Examine the relationship between constitutional law and democratic legitimacy, human rights, and the rule of law.

By the end of this course, students will be able to:
-Identify and explain key constitutional principles and structures.
-Compare constitutional systems across different countries and legal traditions.
-Analyze constitutional texts and judicial decisions.
-Evaluate the effectiveness of constitutional mechanisms in protecting rights and limiting power.
-Engage in informed debate and present well-reasoned arguments on constitutional issues.

for in-class discussion of these assignments. (1-2 hours a week.)
