授業の概要
Building on the foundational theories and structures explored in the spring, the autumn semester of Comparative Constitutional Law traverses real-world constitutional challenges. Guided by John Locke’s vision of constitutionalism, this semester examines how constitutions respond to the pressures of modern governance. From emergency powers and climate change to religious pluralism and rising populism, students will explore how different systems interpret, adapt, and sometimes struggle to uphold constitutional principles. Through comparative case studies, debates, and advocacy projects, students will develop the tools to critically assess the resilience and flexibility of constitutional frameworks in a rapidly changing world.
科目目的
This course is designed for students interested in practical and real-world aspects of constitutional governance in several countries. Students will:
-Test out theories of constitutionalism in real-world situations;
-Understand on a practical level the detailed structures of constitutions and how these seek to limit power;
-Analyze how different countries design and interpret their constitutions;
-Examine further the relationship between constitutional law and democratic legitimacy, human rights, and the rule of law.

By the end of this course, students will be able to:
-Consider in real-world situations key constitutional principles and structures;
-Compare constitutional systems across different countries and legal traditions;
-Assess critically constitutional texts and judicial decisions;
-Evaluate the effectiveness of constitutional mechanisms in protecting rights and limiting power;
-Take part in informed debate and present well-reasoned arguments on practical aspects of constitutional issues.
