授業の概要

The course will provide an overview of the Japanese legal system and its foundations in the English language. It will first introduce students to the historical background of the modern Japanese legal system and its major principles. The course will continue with explaining the structure and nature of the Japanese legal system and will then focus on the particularities of the Japanese legal tradition and general legal thinking in Japan. As one major basis for Japanese legal principles the course will continue by illustrating the Japanese constitution. Thereafter, the class will focus on an give an introduction to individual areas and fields of law, such as administrative law, criminal and criminal procedure law, civil law, commercial law, company law, labor law, intellectual property law and others.

The objectives of the course are to:
- understand the basic nature, legal tradition, legal thinking, and structure of the
Japanese legal system,
- gain the essential knowledge about major areas and fields of the Japanese
legal system,
- comprehend the particularities of Japanese law.

Before each class, students are expected to read the material prepared (if any) and/or to make themselves familiar with the field of law being the topic of the relevant class by reading publicly available material.

Marc Dernauer is a German attorney-at-law and has worked as such in Germany for seven years with a focus on intellectual property law and commercial law. He has advised in particular Japanese companies on the aforementioned fields.
