授業の概要

This course critically examines the 1982 United Nations Convention on the Law of the Sea in light of contemporary disputes and global challenges, including maritime boundary disputes, sea-level rise, illegal fishing, whaling, irregular maritime migration, emerging environmental issues such as marine plastic pollution and underwater noise, modern piracy, and the protection of human rights at sea.

Students are expected to discuss multilateral, regional, bilateral, and unilateral strategies—both formal and informal—adopted by members of the international community to address these challenges, and to examine how such strategies may conflict with or reinforce one another.

In addition to highlighting both the limits and the possibilities of the law of the sea, the course explores cross-cutting issues at the intersection of the law of the sea and other fields of international law, including international human rights law, international criminal law, and international environmental law. It also proposes strategies for the systematic integration of these different international legal disciplines.

科目目的

This course examines contemporary challenges in the law of the sea, analyzes recent international judicial decisions in detail, and discusses how the law of the sea may evolve through law-making, policy-making, and interpretation. The course requires students to actively engage in classroom discussions based on questions posed during lectures.

Students will gain a solid understanding of the law of the sea. They will be expected to critically assess whether existing international law is capable of addressing contemporary challenges and to recommend alternative legal strategies.

Students will be required to read the materials provided for each class. Those who are not familiar with the law of the sea are encouraged to read the relevant chapters of a standard textbook on public international law.

・毎週2回の授業が半期(前期または後期)で完結するもの。1週間あたり8時間の学修を基本とします。

There will be no textbook for this class. A selection of short texts, case commentaries, and newspaper articles will be provided to the students in advance as reading materials.
