Each participant should have an understanding of the administration of criminal justice, criminal law, and criminal procedure of his or her own country, which forms the basis of comparison.
Constitutional law course has a close relationship with this course.

授業の概要
This course examines the framework, rationale, and structure of Japanese criminal law and procedure, comparing them with the those of the United States, England, and civil law countries (and, where feasible, participants' home countries). Through this comparative analysis, the course highlights significant differences in the administration of criminal justice, encouraging participants to reflect on these variations and their underlying rationales.

The aim of this course is to provide participants with an accurate and critical understanding of the fundamental concepts, principles, and rules underlying the Japanese criminal justice system from a comparative perspective. Participants will also gain an overview of its key practices, current issues, and recent trends.

After successfully completing this course, participants will be able to:
• Describe the framework of Japanese criminal law and procedure, including key practices, current issues and recent trends.
• Explain and discuss the fundamental concepts, principles, and rules of the Japanese criminal justice system from comparative perspectives.

1st Week: Introduction
2nd Week: Trends and current situation of crime problems and crime policy (Prof. Tsutsumi)
3rd Week: Why do we punish? Some rationales and their implication (Prof. Tsutsumi)
4th Week: Crime as a legal concept: tripartite and bipartite structure (Prof. Tsutsumi)
5th Week: Mens rea: how do we conceive an agency under criminal law? (Prof. Tsutsumi)
6th Week: Who commits a crime? A natural person, a corporation and an organization (Prof. Tsutsumi)
7th Week: The urgent crime problem: what the penal law is faced with (Prof. Tsutsumi)
8th Week: Japan's Criminal Procedure: An Overview and Comparison (Assoc. Prof. Miake)
9th Week: Investigation 1: Search and Seizure etc. (Assoc. Prof. Miake)
10th Week: Investigation 2: Arrest and Detention, and Interrogation (Assoc. Prof. Miake)
11th Week: Prosecution: How Are Cases Brought to Court? (Assoc. Prof. Miake)

This course will often draw comparisons between the Japanese criminal justice system and that of Western countries, as well as between the common law and civil law systems. Participants are encouraged to engage in comparative preparation and research on the topics covered in the course.

その他特記事項
• Though classes will be held in English, some legal terms specific to the Japanese system may be referred to in Japanese -- not with Kanji but with Alphabet.
• Graduate and Undergraduate classes are combined in this course.
Graduate students in this course are expected to compare criminal Justice in Japan with those of their own countries. In doing so, they should put their main focus on basic thinking and underlying rationale, which will give them a deeper understanding of their own country as well as a grasp of the characteristics and background of criminal justice in Japan. The comparison would lead them to further thinking on the sound administration of criminal justice in their own cultural settings.
