授業の概要
This course explores some of the key debates about Japanese law. For example, you will explore the different explanations provided for Japan's relatively low litigation rates. You will consider the extent to which soft law is a key feature of Japan's legal governance. And you will question whether the Japanese legal system is undergoing rapid transformation or gentle reform.
科目目的
The objectives of the course are to advise foreign clients new to Japan about:
- the core features of the Japanese legal system, its history, institutions and recent notable reforms;
- the reasons why Japanese litigation rates remain low compared to other industrialized democracies throughout the world;
- the extent to which Japanese culture explains contracting and other commercial practices;
- the effectiveness of the rule of law in Japan's system of public governance; and
- the nature of Japan's social system and whether the law optimizes social justice outcomes for women, children, workers and other groups in society.

At the completion of this unit, you will be able to:
- identify and evaluate the contextual factors—the political, economic, cultural, social and institutional—that impact on the function of law and legal institutions in Japan;
- define and defend a comparative legal model of problem-solving that allows you to identify key distinguishing features about the Japanese legal system and explain how they impact on law’s operation in the real world; and
- reach informed comparative judgements about the Japanese legal system.

Week 03: Business Negotiations (relevance of culture)
Week 04: Contracts (relevance of culture)
Week 05: Litigation I (cultural explanations)
Week 06: Litigation II (rival explanations)
Week 07: Family law
Week 08: Criminal Justice
Week 09: Executive (administrative law and guidance)
Week 10: Judiciary (judicial independence, activism and bias)
Week 11: Gender (equal employment opportunity)
Week 12: Work (bullying and harassment)
Week 13: Future
